1. About these terms
These Terms of Service (“Terms”) govern your use of utilitycampus.com (the “Site”), which is operated by Utility Campus, LLC (“Utility Campus,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms apply to use of the Site itself. Purchases of our publications are also governed by our Sales Policy, and submission of personal information through the Site is governed by our Privacy Policy.
2. About the Site
The Site is the public website of Utility Campus, LLC, a Maryland limited liability company that publishes K–12 STEM curriculum and related educational materials. The Site provides information about our publications, allows institutional purchasers to request bulk-order quotes, and provides links to retail channels where individual copies of our publications may be purchased.
The Site is not a marketplace, a transaction platform, or a community forum. We do not host user accounts, user-generated content, comments, or third-party listings. Purchases of our publications occur either through third-party retail channels (such as Amazon and IngramSpark) or, for institutional orders, through a quote-request process described in our Sales Policy.
3. Use of the Site
You may use the Site for lawful personal and professional purposes — to learn about our publications, to review our standards alignment, to request a sample, to submit a quote-request, and to contact us with inquiries. You agree not to:
- Use the Site to engage in any unlawful activity.
- Attempt to access portions of the Site that are not intended for public access (such as administrative interfaces).
- Attempt to disrupt, overload, or impair the operation of the Site.
- Use automated systems (bots, scrapers, crawlers) to access the Site, except for well-behaved search-engine crawlers operating in accordance with our robots.txt file.
- Submit false, misleading, or fraudulent information through any form on the Site.
- Use the Site or its content to develop or train any machine learning or artificial intelligence model, without our express prior written consent.
4. Intellectual property
Our content. The Site and all content displayed on it — including text, illustrations, photographs, logos, page designs, and the underlying organization and selection of content — are owned by Utility Campus, LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws. The names “Utility Campus,” How Public Utilities Work, and related logos and product designations are trademarks of Utility Campus, LLC.
Permitted use. You may view and read content on the Site for your personal or professional reference. You may share a link to any page of the Site, and you may quote brief excerpts of Site content in academic, journalistic, or educational contexts with proper attribution. You may not copy, reproduce, distribute, republish, modify, or create derivative works from Site content without our express written permission.
Use of our publications. Reproduction and educational use of our published curriculum products is governed by the terms set forth in those publications and in our Sales Policy, not by these Terms.
Third-party trademarks. Trademarks owned by third parties — including the STEM.org Accredited™, STEM.org Reviewed™, and Best In STEM™ trustmarks — are the property of their respective owners and are displayed on the Site under license or in accordance with the owners’ guidelines.
5. Links to external sites
The Site contains links to external websites — including STEM.org validation portals, retail channels such as Amazon and IngramSpark, and standards organizations such as NGSS and NCSS. These external sites are operated by third parties, and we have no control over their content, privacy practices, or terms of use. Links from our Site to external sites do not constitute endorsement of those sites or their operators.
Your use of external sites is governed by the terms and policies of those sites, not by these Terms.
6. Disclaimers
Informational nature of the Site. Information on the Site, and in our publications, is provided for educational purposes. Nothing on the Site constitutes legal advice, regulatory guidance, an official position of any regulatory body, financial advice, engineering advice, or a recommendation regarding any specific utility, energy provider, rate case, tariff, or commercial transaction.
No warranty. The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
Accuracy. We make reasonable efforts to ensure that information on the Site is accurate and current. However, regulatory frameworks, utility-industry practices, and educational standards change over time, and we cannot guarantee that all information on the Site is current at any given moment. Where currency matters, you should consult primary sources.
7. Limitation of liability
To the maximum extent permitted by law, Utility Campus, LLC and its members, officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising out of or related to your use of the Site is limited to one hundred U.S. dollars ($100), or, if you have purchased one of our publications through the quote-request process, to the amount you paid for that publication, whichever is greater.
8. Indemnification
You agree to indemnify, defend, and hold harmless Utility Campus, LLC and its members, officers, employees, agents, and affiliates from any claim, liability, loss, damage, or expense (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Site, your violation of applicable law, or your infringement of any third party’s rights.
9. Governing law and disputes
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws principles. Any dispute arising out of or related to your use of the Site, or arising out of these Terms, is subject to the exclusive jurisdiction of the state and federal courts located in Maryland, and you consent to personal jurisdiction in those courts.
10. Changes to these terms
We may modify these Terms from time to time. When we make material changes, we will update the Effective Date at the top of this page and provide reasonable notice. Your continued use of the Site after we post changes constitutes your acceptance of those changes. If you do not agree to the modified Terms, you should stop using the Site.
11. Severability and entire agreement
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and Sales Policy, constitute the entire agreement between you and Utility Campus, LLC regarding your use of the Site.
